Notice of Zoning Hearing


NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Commission of the City of Sunny Isles Beach, Florida, in the Commission Chambers, Sunny Isles Beach Government Center, 18070 Collins Avenue, Sunny Isles Beach, Florida on Thursday, September 22nd, 2005 at 7:00 p.m., to consider the following Zoning applications:

A. St. Tropez II, LLC

Location: 150 - 260 Sunny Isles Boulevard
Public Hearing #: Z2005-04

Summary: The applicant is requesting a modification to previous approved plans. Accompanying this request is a request for a variance of setback from the rear property line.

  1. Modification of plans approved under Condition #3 of Resolution 05-Z-91 passed and adopted by the City Commission on March 22nd, 2005 reading as follows:

Plans are on file and may be examined in the Zoning Department entitled “St Tropez on the Bay”, prepared by Kobi Karp Architecture & Interior Design, consisting of 17 sheets dated received 1-26-05 and plans entitled “Boundary Survey, Paving and Drainage Plans”, prepared by Fortin, Leavy, Skiles, Inc., consisting of 4 sheets dated stamped received 1-26-05 and plans entitled “St Tropez on the Bay”, prepared by Marlin Engineering dated 01-21-05 and plans entitled “Lighting and Landscape”, prepared by EGS2 Corp dated stamped received 1-26-05. Plans may be modified at public hearing.

That the project shall be developed substantially in accordance with the plan submitted for public hearing for “St Tropez II, LLC” and are on file with the City Zoning Department entitled “St Tropez on the Bay”, prepared by prepared by Kobi Karp Architecture & Interior Design, consisting of 17 sheets dated received 8-01-05 and plans entitled “Boundary Survey”, prepared by Fortin, Leavy, Skiles, Inc., dated stamped received 8-01-05 and plans entitled “Paving and Drainage, Water and Sewer plans and details”, consisting of 5 sheets prepared by Marlin Engineering dated 8-01-05 plans entitled “Sign and Paving Markings”, consisting of 4 sheets prepared by Marlin Engineering dated revised 8-04-05 and plans entitled “Lighting and Landscape”, consisting of 4 sheets, prepared by EGS2 Corp dated 8-01-05. Plans may be modified at public hearing. All conditions approved under Resolution 05-Z-91 remain in affect.

The purpose of this request is to modify the previously approve plans to comply with the requirements of the Department of Environmental Resources and Management (DERM) regarding the bulkhead along the rear of the property.

2. Variance of Section 265-37 requiring the towers above the garage pedestal to setback zero (0’) feet from the edge of the garage pedestal (10 feet required).

Aforementioned plans are on file and may be examined in the Zoning Department. Plans may be modified at public hearing.

All persons are invited to appear at this meeting or be represented by an agent, or to express their views in writing addressed to the City Clerk, City of Sunny Isles Beach, 18070 Collins Avenue, Sunny Isles Beach, Florida, 33160. The courts have ruled that it is improper to contact a City Commission member individually, either orally or in writing about any zoning applications. Maps and other data pertaining to these applications are available for public inspection during normal business hours in City Hall. Any zoning hearing may be continued at this meeting and under such circumstances, additional legal notice would not be provided. Any persons wishing to speak at a public hearing should register with the City Clerk prior to that item being heard.

Inquiries regarding the item may be directed to the City’s Zoning Department at 305-947-2150. Please refer to the hearing number when making an inquiry.

If a person decides to appeal any decision made by the City Commission with respect to any matter considered at such meeting or hearing, they will need a record of the proceedings and, for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. This notice does not constitute consent by the City for introduction or admission of otherwise inadmissible or irrelevant evidence, nor does it authorize challenges or appeals not otherwise allowed by law.
