The Declaration of Local Emergency has been CANCELED effective May 26, 2021.
WHEREAS, pursuant to Chapter 29 of the City of Sunny Isles Beach Code, the City Manager hereby finds and declares the following:
- Due to COVID-19 and the Declaration of a State of Emergency by Governor Ron DeSantis, the City of Sunny Isles Beach is facing dangerous conditions of sufficient severity and magnitude to warrant coordinated local government action to prevent or alleviate the damage, loss, hardship or suffering threatened or caused thereby;
- Due to COVID-19, a condition of extreme peril of public health and welfare necessitates the proclamation of the existence of an emergency;
NOW, THEREFORE, IT IS HEREBY RESOLVED that an emergency now exists throughout the City of Sunny Isles Beach;
IT IS FURTHER RESOLVED that during the existence of said emergency the powers, functions, and duties of the City Manager/designee of the City of Sunny Isles Beach be those prescribed by State law and the ordinances, resolutions, and approved plans of the City of Sunny Isles Beach in order to mitigate the effects of said emergency.

City of Sunny Isles Beach Emergency Orders
[/accordion]EMERGENCY ORDER 01-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY (TERMINATED)

WHEREAS, on March 19, 2020, the City Manager extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, the detailed findings of governor DeSantis’ Executive Orders No. 20-52 and No. 20-68 are hereby incorporated herein by reference; and
WHEREAS, the detailed findings of Miami-Dade County Mayor Gimenez in Emergency Order No. 07-20 are hereby adopted and incorporated herein by reference;
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
- All gymnasiums, fitness centers, and swimming pools located in condominiums, rental apartments, condominium hotels, hotels, and motels within the jurisdictional limits of the City of Sunny Isles Beach are hereby ordered CLOSED, effective noon today, March 22, 2020 and shall continue until further notice.
- In order to protect the public health, safety and welfare, and in an effort to mitigate the spread of the COVID-19 virus, a curfew is hereby established within the jurisdictional limits of the City of Sunny Isles Beach, which curfew shall commence March 22, 2020 and continue until further notice between the hours of 11:00 p.m. and 5:00 a.m. No person shall be outside within the City during the curfew hours either as a pedestrian or by means of any vehicle, unless such person is providing police, fire, or other governmental services; providing assistance expressly requested by police, fire, or governmental personnel; or participating in, going to, or returning from a place of work or occupation. No person shall occupy any outside area during the curfew hours except upon the express authorization of the City of Sunny Isles Beach Police Department. This Order shall not prohibit a person from walking a pet animal in the vicinity of his or her residence at which the animal is being maintained.
EMERGENCY ORDER 02-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY (TERMINATED)

WHEREAS, on March 26, 2020 the City Manager again extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, Miami-Dade County Mayor Gimenez, in Emergency Order No. 09-20 dated March 21, 2020, which is hereby adopted and incorporated herein by reference, ordered that hotels and motels and other commercial lodging establishments in Miami-Dade County not to accept any new reservations other than from Essential Lodgers, as that term is defined therein and below; and
WHEREAS, this Emergency Order is necessary because of the propensity of the COVID-19 virus to imperil the lives and well-being of individuals both due to the possible person-to-person transmission and the virus’ proclivity to attach to surfaces for a prolonged period of time rendering those surfaces damaged and unusable, thereby physically causing property damage; and
WHEREAS, in order to ensure that hotels, motels, short-term rentals and other commercial lodging establishments comply with the mandate to close and to not accept any new reservations except for Essential Lodgers; and
WHEREAS, in Emergency Order 10-20 dated March 24, 2020, which is hereby adopted and incorporated by reference, Miami-Dade Mayor Gimenez urged people to stay at home other than to engage in essential activities; and
WHEREAS, due to the continued spread of COVID-19, it has become necessary to require people to remain at home other than to engage in essential activities.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
- To aid the availability of hotel rooms for (1) healthcare professionals, (2) first responders, (3) National Guard members, (4) law enforcement personnel, (5) state or federal government employees, (6) airline crewmembers, (7) patients, (8) patients’ families, (9) journalists, (10) others responding to COVID-19, (11) displaced residents or visitors, (12) persons unable to return to their homes due to COVID-19 impacts on travel, (13) persons who must vacate their homes due to exigent circumstances, such as fire or flood, (14) persons utilizing hotel rooms as transitional living arrangements, (15) persons sheltering in hotels due to domestic violence, (16) hotel employees, service providers, and contractors, or (17) individuals who, for any reason, are temporarily unable to reside in their home (collectively, “Essential Lodgers”), the following restrictions shall apply to all commercial lodging establishments within the jurisdictional limits of the City of Sunny Isles Beach:
(a) Hotels, motels, and other commercial lodging establishments shall not accept new reservations for persons other than Essential Lodgers.
(b) Hotels, motels, and other commercial lodging establishments may accept reservations for new Essential Lodgers.
(c) Commencing March 26, 2020, hotels, motels, short-term vacation rentals, and other commercial lodging establishments shall not (i) accept any occupants, regardless of when reservations were made, or (ii) extend existing reservations, for persons other than Essential Lodgers.
- Individuals are hereby ORDERED to remain at home other than to engage in essential activities, which include, without limitation, travel to or from essential retail and commercial businesses as defined in Miami-Dade Emergency Order 07-20. Individuals outside their homes shall not gather in groups of 10 or more individuals on any public street, alley, public way, sidewalk, or government facility open to the public in the City of Sunny Isles Beach.
- The provisions of this Emergency Order shall be effective immediately and shall expire upon the expiration of the Declared State of Local Emergency, except that if the Declared State of Local Emergency is extended, this Emergency Order shall also be deemed to extend for the duration of such extension.
- This Emergency Order may be cancelled earlier by the City Manager.
EMERGENCY ORDER 03-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY (TERMINATED)

OCCUPIED MULTI-FAMILY RESIDENTIAL BUILDING CONSTRUCTION
WHEREAS, on March 12, 2020 the City Manager declared a Local Emergency as a result of COVID-19; and
WHEREAS, on March 19, 2020 the City Manager extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, on March 26, 2020 the City Manager again extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, on April 2, 2020, the City Manager again extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, Governor DeSantis issued Executive Order Number 20-89 ordering Miami-Dade, Broward, Palm Beach and Monroe Counties to restrict public access to businesses and facilities deemed non-essential, and adopted a list of essential services set forth in Miami-Dade County Emergency Order No. 07-20; and
WHEREAS, the list contained in Miami-Dade County Emergency Order No. 07-20 included contractors and tradesmen, appliance repair personnel, exterminators, and other service providers (“Service Providers”) who provide services that are necessary to maintaining the safety, sanitation, and essential operation of residences and businesses; and
WHEREAS, this Emergency Order is necessary because of repeated reports of Service Providers providing services that are not necessary to maintaining the safety, sanitation and essential operation of residences, and especially occupied multi-family residential buildings; and
WHEREAS, in order to ensure that only those services that are necessary to maintaining the safety, sanitation and essential operation of occupied multi-family residential buildings, and to ensure that non-essential services are not being provided in those buildings, this Emergency Order is necessary.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
- The only essential construction activities that are permitted to be made in occupied multi-family residential buildings within the City of Sunny Isles Beach are as follows:
- Repairs or replacement of air conditioning systems, water heaters, malfunctioning plumbing or malfunctioning electrical systems;
- Structural work that is part of the 40-year recertification that cannot be halted due to life safety matters;
- Repair or construction relating to the structural integrity / life safety of the occupied multi-family residential building;
- New shutter/window installation in preparation for hurricane season;
- Needed roofing repairs or re-roofing;
- Fire sprinkler system installation and repair; and
- Fire alarm installation and repair.
- The Service Provider is required to maintain the following practices for permitted work under this Order in occupied multi-family residential buildings:
- Provide alcohol-based hand sanitizer that contains at least 60% alcohol at all elevators and all floors;
- Provide and require the use of an alcohol-based hand sanitizer before entering and leaving the building;
- Require that all workers use personal protective equipment, including gloves, goggles/glasses, and respiratory protection;
- Practice social distancing per CDC guidelines and work in teams of no more than 10 people in one area. Adjust project/work schedules to comply with social distancing practices.
- No other installations, repairs or replacements shall be conducted on any occupied multi-family residential buildings in the City of Sunny Isles Beach during the pendency of the Declared State of Local Emergency.
- Failure to abide by any part of the Order, or City requirements issued pursuant to this Order, shall result in penalties up to and including a Stop Work Order, or other measures deemed appropriate by the City’s Building Official.
- The provisions of this Emergency Order shall be effective Friday, April 10, 2020 at 5:00 p.m. and shall expire upon the expiration of the Declared State of Local Emergency, except that if the Declared State of Local Emergency is extended, this Emergency Order shall also be deemed to extend for the duration of such extension.
- This Emergency Order may be cancelled earlier by the City Manager.
EMERGENCY ORDER 04-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY (CANCELED)

WHEREAS, on March 12, 2020 the City Manager declared a Local Emergency as a result of COVID-19; and
WHEREAS, on March 19, 2020 the City Manager extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, on March 26, 2020 the City Manager again extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, on April 2, 2020, the City Manager again extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, Governor DeSantis issued Executive Order Number 20-89 ordering Miami-Dade, Broward, Palm Beach and Monroe Counties to restrict public access to businesses and facilities deemed non-essential, and adopted a list of essential services set forth in Miami-Dade County Emergency Order No. 07-20; and
WHEREAS, Miami-Dade County Emergency Order No. 17-20 encourages all essential businesses to abide by Centers for Disease Control and Florida Department of Health guidelines on personal protective equipment (PPE) and social distancing; and
WHEREAS, this Emergency Order is necessary to ensure that Open / New Construction Sites in Progress operate in compliance with City, County, State, and Centers for Disease Control guidelines to maintain the health, safety and welfare of the City while complying with State and County Orders of permitting essential businesses.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
- General Contractors of Open / New Construction Sites in Progress shall strictly adhere to CDC guidelines and the Joint Construction Industry Commitment issued on March 23, 2020: Pledge to Reduce the Spread of Novel Coronavirus on South Florida’s Construction Sites attached hereto for reference as Exhibit A, and by adhering to the following best practices:
- All workers shall be provided alcohol-based hand sanitizer that contains at least 60% alcohol before entering and leaving the constructions sites;
- All workers shall be required to use personal protective equipment (PPE), including gloves, goggles/glasses, and respiratory protection at all times while at the work site, as well as traversing to and from the work site.
- Open / New Construction Sites in Progress shall be limited to 10 or fewer persons at a single-family residential construction site, and 10 or fewer persons per work area on all other construction sites;
- All workers shall be required to remain on the work site for the duration of their workday, inclusive of lunch and other breaks, and may not congregate in the public right of way except to traverse to and from the work site;
- Temporary structures, portable toilets, other such construction site equipment and all frequently touched areas must be sanitized routinely;
- Staggered shifts are encouraged to ensure the ability of workers to abide by social distancing guidelines; and
- Contractors shall post additional signage at jobsites advising of CDC guidelines to prevent the spread of COVID-19, inclusive of Social Distancing, use of PPE, staying home when ill, physical signs of COVID-19 and where to report non-compliance.
- If directed by the City, any other measures necessary to promote the public health, safety and welfare shall be implemented by the Contractor.
- Failure to abide by any part of this Order, or City requirements issued pursuant to this Order, shall result in penalties up to and including a Stop Work Order, or other measures deemed appropriate by the City’s Building Official.
- The provisions of this Emergency Order shall be effective Friday, April 10, 2020 and shall expire upon the expiration of the Declared State of Local Emergency, except that if the Declared State of Local Emergency is extended, this Emergency Order shall also be deemed to extend for the duration of such extension.

EMERGENCY ORDER 05-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY (TERMINATED)

WHEREAS, on April 2, 2020, the City Manager again extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, on April 9, 2020, the City Manager again extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, on April 16, 2020, the City Manager again extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, on April 23, 2020, the City Manager again extended the declared state of Local Emergency for an additional seven (7) days; and
WHEREAS, the effects of COVID-19 continue to require extraordinary and immediate actions by the City of Sunny Isles Beach in order to protect the public‘s health, safety, and welfare; and
WHEREAS, COVID-19 is a natural emergency whose increasing effects are being felt within the City of Sunny Isles Beach and that on account thereof, there is reason to believe that it is necessary to take whatever prudent action is necessary to ensure the health, safety, and welfare of the residents of City of Sunny Isles Beach; and
WHEREAS, Miami Dade County Emergency Order 21-20 provides that parks and recreational facilities within incorporated areas of Miami Dade County may open, subject to limitation, and further provides that municipalities may impose more stringent standards within their jurisdiction as may be authorized by law; and
WHEREAS, parks and recreational facilities are potential gathering places for the spread of COVID-19; and
WHEREAS, due to the limited size of the City’s parks, it is impractical to allow residents to congregate and still maintain the social distancing guidelines which are still in effect; and
WHEREAS, the City of Sunny Isles Beach does not believe that based on the currently available data relating to the number of new cases of COVID-19 and associated hospitalizations that this is the appropriate time to begin reducing safety measures intended to protect its residents; and
WHEREAS, it is necessary and appropriate to take action to ensure that COVID-19 does not continue to spread and that the residents and employees of the City of Sunny Isles Beach remain safe and secure.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
- All publicly owned parks and recreational facilities shall remain closed in the City of Sunny Isles Beach. This Order shall not apply to privately owned parks and recreational facilities.
- The provisions of this Emergency Order shall be effective immediately and shall expire at 7:59 a.m. on Wednesday, May 6, 2020.
- This Emergency Order may be cancelled earlier by the City Manager.
EMERGENCY ORDER 06-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY
LIMITED PARK REOPENING AND GUIDELINES (TERMINATED)

WHEREAS, on March 12, 2020 the City Manager declared a Local Emergency as a result of COVID-19; and
WHEREAS, on March 19, 2020, March 26, 2020, April 2, 2020, April 9, 2020, April 16, 2020, April 23, 2020, and April 30, 2020, the City Manager declared extensions to the State of Local Emergency; and
WHEREAS, on April 3, 2020, the CDC recommended that persons wear cloth facial coverings while in public to help control the spread of COVID-19; and
WHEREAS, on April 27, 2020, Miami Dade County issued Emergency Order 21-20 allowing parks and recreational facilities to open on April 29, 2020, under limited circumstances, and further providing that municipalities may impose more stringent standards within their jurisdiction as may be authorized by law; and
WHEREAS, on April 29, 2020, the City of Sunny Isles Beach took additional steps to minimize the spread of COVID-19 and issued Emergency Order 05-20, providing that all publicly owned parks and recreational facilities remain closed, and providing for the expiration of the Order at 7:59 a.m. on Wednesday, May 6, 2020; and
WHEREAS, it is important for the physical and mental health of the community that outdoor recreation be allowed to the extent it is safe to do so; and
WHEREAS, consistent with the direction taken by Miami Dade County, the City of Sunny Isles Beach desires to reopen certain parks and recreational facilities following the expiration of Emergency Order 05-20, but only as expressly stated below, to provide the community with opportunities to exercise and obtain other health benefits during this continuing crisis; and
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
1.Findings.
The detailed findings of Miami-Dade County Mayor Gimenez, as contained in Emergency Order 21-20, dated April 27, 2020, are hereby adopted and incorporated herein by reference.
2. Continuing Adherence to CDC Guidelines.
Notwithstanding the limited reopening of certain parks under this Emergency Order, all individuals shall continue to adhere to the guidelines from the Centers for Disease Control and Prevention, hereinafter referred to as the “CDC Guidelines”.
3. Limited Reopening of Park and Recreational Facilities and Guidelines.
Effective as of 8:00 a.m., Wednesday, May 6, 2020, the City of Sunny Isles Beach will allow public access to Sunny Isles Beach residents with proper identification on a limited basis to a select number of parks and recreational facilities as set forth below.
A. Effective as of 8:00 a.m., Wednesday, May 6, 2020, public access is permissible at the below listed parks, subject to the limitations set forth herein:

D. Usage Schedule:
In order to mitigate a large number of residents crowding the parks at the same time, making social distancing difficult, the City will follow a usage schedule based on the resident’s home address, as follows:
Residents living in houses or apartments with an even numbered address may visit parks on Mondays, Thursdays, and Saturdays.
Residents living in houses or apartments with an odd numbered address may visit parks on Wednesdays, Fridays, and Sundays.
E. Guidelines:

- Individuals using the parks are required to adhere to CDC Guidelines concerning facial covering, with the exception of children under two years old, or persons who have trouble breathing due to a chronic pre-existing condition.
- Minors shall always be accompanied by a parent or guardian.
- Groups larger than ten (10) people are prohibited from gathering in one place.
- Use of parks and recreational facilities shall be for limited passive uses, such as walking, jogging, running, stretching, biking and exercise.
- Park use is encouraged to be limited to one hour or less.
- Directional signage along sidewalks and walkways, established to minimize cross contact, shall be adhered to.
- Restrooms at the park will be open for only one (1) person or family at a time.
F. Use of the following amenities is prohibited:

- playgrounds;
- tables;
- fitness equipment;
- water fountains;
- bicycle racks;
- water features; and
- dog parks.
G. Prohibition of Animals:

- No animals are permitted in any parks with the exception of recognized service animals.
H. Parking Limitations:

- Parking garages and lots at each park remain open only to Sunny Isles Beach residents.
I. Beach Closures:

- Pursuant to Miami-Dade County Emergency Order 06-20, all beaches in Sunny Isles Beach shall remain closed to the public.
4. Enforcement.
The City of Sunny Isles Beach Police Department, and other authorized City personnel, are authorized to enforce this Emergency Order.
5. Applicability; Severability.
This Emergency Order supersedes any contrary provision in any prior City of Sunny Isles Beach Emergency Order. Except as superseded, all City of Sunny Isles Beach Emergency Orders remain in full force and effect.
6. Effective Date; Duration.
The provisions of this Emergency Order shall become effective at 8:00 a.m., Wednesday, May 6, 2020, and shall expire upon the expiration of the existing State of Local Emergency, as same may be extended by subsequent order or declaration, unless terminated earlier by the City Manager.

EMERGENCY ORDER 07-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY (TERMINATED)

WHEREAS, the City Manager has extended the declared state of Local Emergency every seven (7) days since that date; and
WHEREAS, on March 26, 2020, the City Manager issued an Emergency Order and Supplement to Declared State of Emergency which adopted Miami-Dade County Mayor Gimenez’s Emergency Order 10-20 regarding hotels, motels, sho1i-term vacation rentals and other commercial lodging establishments; and
WHEREAS, the City Manager’s Emergency Order 02-20 and Supplement to Declared State of Emergency ordered individuals to remain at home other than to engage in essential activities; and
WHEREAS, the Governor, via Executive Order 20-122 has allowed Miami-Dade County to proceed to Phase 1 of the Safe, Smart, Step by Step Plan for Florida’s Recovery, subject to the limitations imposed in Executive Order 20-112 paragraphs two through six; and
WHEREAS, On May 15, 2020, Mayor Gimenez issued Emergency Order 23-20 which permits retail and commercial establishments to open for business, provided that each such establishments follow the requirements set fo1ih in Emergency Order 23-20 and the “Moving to a New Normal Handbook” attached to that Emergency Order as Exhibit A, in addition to the supplemental guidelines for outdoor restaurant dining attached to that Emergency Order as Exhibit B; and
WHEREAS. the City of Sunny Isles Beach desires to adopt the provisions of Emergency Order 23-20 and its incorporated exhibits in order to permit retail and commercial establishments to open for business consistent with the direction taken by Miami Dade County.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
1. Miami-Dade County Mayor Gimenez’s Emergency Order 23-20 and its incorporated exhibits are hereby adopted and incorporated herein by reference.
2. All retail and commercial establishments, as defined in Emergency Order 23-20, located within the jurisdiction of the City of Sunny Isles Beach that wish to open shall follow the provisions of Emergency Order 23-20.
3. All prior Emergency Orders shall remain in effect except to the extent modified by this Emergency Order 07.
4. The provisions of this Emergency Order shall be effective immediately and shall expire upon the expiration of the Declared State of Local Emergency, except that if the Declared State of Local Emergency is extended, this Emergency Order shall also be deemed to extend for the duration of such extension.
5. This Emergency Order may be cancelled earlier by the City Manager.

WHEREAS, on March 26, 2020, the City Manager issued Emergency Order 02-20 and Supplement to Declared State of Emergency, ordering individuals to remain at home other than to engage in essential activities, and adopting Miami-Dade County Mayor Gimenez’s Emergency Order 10-20 regarding hotels, motels, short-term vacation rentals and other commercial lodging establishments; and
WHEREAS, on April 8, 2020, the City Manager issued Emergency Order 03-20 and Supplement to Declared State of Emergency, limiting construction activities in multi-family buildings; and
WHEREAS, on May 1, 2020, the City Manager issued Emergency Order 06-20 and Supplement to Declared State of Emergency, reopening certain parks and recreational facilities subject to restrictions; and
Whereas, Emergency Order 06-20, Paragraph (3)(A) lists Samson Oceanfront Park, located at 17425 Collins Avenue, as a park that would be opened on a limited basis, subject to the limitations set forth therein; and
WHEREAS, Emergency Order 06-20, Paragraph (3)(B) ordered the continued closure of Newport Fishing Pier, located at 16501 Collins Avenue; and
WHEREAS, Emergency Order 06-20, Paragraph (3)(I) ordered the continued closure of all beaches in Sunny Isles Beach pursuant to Miami-Dade County Emergency Order 06-20; and
WHEREAS, on May 14, 2020 the Governor, via Executive Order 20-122 has allowed Miami-Dade County to proceed to Phase 1 of the Safe, Smart, Step by Step Plan for Florida’s Recovery, subject to the limitations imposed in Executive Order 20-112 paragraphs two through six; and
WHEREAS, On May 15, 2020, Miami Dade County Mayor Gimenez issued Emergency Order 23-20 which permits retail and commercial establishments to open for business, provided that such establishments follow the requirements set forth in the “Moving to a New Normal Handbook” and supplemental guidelines for outdoor restaurants, both attached and incorporated into said order; and
WHEREAS, the City of Sunny Isles Beach desires to relax its restrictions, consistent with the direction taken by Miami Dade County, by rescinding the City’s Emergency Orders 01-20, 02-20, and 03-30, and allowing those activities to be regulated and governed by any existing and future Emergency Orders issued by Miami Dade County Mayor Gimenez; and
WHEREAS, the City of Sunny Isles Beach further desires to amend Emergency Order 06-20, Paragraph (3)(A) to remove Samson Oceanfront Park from the list of parks subject to limited reopening, thereby allowing further public access, but only as expressly stated below; and
WHEREAS, the City of Sunny Isles Beach further desires to amend Emergency Order 06-20, Paragraph (3)(B) to remove Newport Fishing Pier from the list of parks ordered to remain closed, thereby permitting that it reopen, but only as expressly stated below; and
WHEREAS, the City of Sunny Isles Beach further desires to amend Emergency Order 06-20, Paragraph (3)(I) to remove the language governing beach closures, thus allowing those activities to be regulated and governed by any existing and future Emergency Orders issued by Miami Dade County Mayor Gimenez.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
- Emergency Orders 01-20, 02-20, and 03-20 are hereby rescinded.
- Emergency Order 06-20 is hereby amended as follows:
a. Samson Oceanfront Park shall be removed from the list of parks subject to a limited reopening in Paragraph (3)(A), and said park shall only be governed by the restrictions provided herein:
i. Hours of Operation: 7:00 am – 8:00 pm, which hours may be amended by the City Manager at his discretion.
ii. All persons must comply with the protocols set forth in the “Moving to a New Normal Handbook” governing Parks and Open Spaces, as may be amended.b. Newport Fishing Pier shall be removed from the list of parks ordered to remain closed in Paragraph (3)(B), thereby permitting that it reopen, and said park shall only be governed by the restrictions provided herein:
i. Hours of Operation: 7:00 am – 8:00 pm, which hours may be amended by the City Manager at his discretion.
ii. All persons must comply with the protocols set forth in the “Moving to a New Normal Handbook” governing Parks and Open Spaces, as may be amended.
iii. Due to the limited number spaces on Newport Fishing Pier, City of Sunny Isles Beach residents will be given preference.c. Paragraph (3)(I), mandating beach closures, shall be stricken from the order, thus allowing those activities to be regulated and governed by any existing and future Emergency Orders issued by Miami Dade County Mayor Gimenez.
- All prior Emergency Orders shall remain in effect except to the extent modified by this Emergency Order 08.
- The provisions of this Emergency Order shall become effective at 7:00 am, Monday, June 1, 2020, and shall expire upon the expiration of the existing State of Local Emergency, as same may be extended by subsequent order or declaration, unless terminated earlier by the City Manager.
EMERGENCY ORDER 09-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY (TERMINATED)

WHEREAS, on June 4, 2020, Miami Dade County Mayor Gimenez issued Amendment No. 2 to Emergency Order 21-20, which permits dog parks to reopen, if operated in accordance with the Moving to A New Normal Handbook and Emergency Order 23-20; and
WHEREAS, the City of Sunny Isles Beach desires to further relax its restrictions, consistent with the direction taken by Miami Dade County, by issuing a second amendment to Emergency Order 06-20, to allow dog parks to reopen.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
- Paragraph 3 of Emergency Order 06-20, as amended, is hereby amended and restated as follows:
- Limited Reopening of Park and Recreational Facilities and Guidelines.
Effective as of 8:00 a.m., Wednesday, May 6, 2020, the City of Sunny Isles Beach will allow public access to Sunny Isles Beach residents with proper identification on a limited basis to a select number of parks and recreational facilities as set forth below.

EMERGENCY ORDER 10-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY (EXPIRED)
[accordion-item title=”Read Emergency Order 10-20″ state=closed]WHEREAS, on March 12, 2020, the City Manager of the City of Sunny Isles Beach (“City”) declared a Local Emergency as a result of COVID-19; and
WHEREAS, the City Manager has extended the declared state of Local Emergency every seven (7) days since that date; and
WHEREAS, according to the Centers for Disease Control (“CDC”), COVID-19 spreads mainly from person to person through respiratory droplets produced when an infected person coughs, sneezes, or talks. These droplets can land in the mouths or noses of people who are nearby or possibly be inhaled into the lungs; and
WHEREAS, many persons infected by COVID-19 are contagious while they are asymptomatic, and can therefore spread the disease unwittingly; and
WHEREAS, prolonged close contact between people enhances the risk of spreading COVID-
19; and
WHEREAS, COVID-19 cases have recently spread rapidly in Miami-Dade County; and
WHEREAS, the increasing effects of COVID-19 continue to require immediate and extraordinary actions by the City in order to protect the safety, health, and welfare of the public due to the propensity of COVID-19 to spread person to person; and
WHEREAS, COVID-19 poses a health risk to Miami-Dade County residents and visitors, particularly those who are elderly, immunosuppressed or otherwise have high-risk medical conditions; and
WHEREAS, the long-term effects of COVID-19 on persons who recover are currently unknown; and
WHEREAS, hospital capacity and medical availability is diminishing as COVID-19 patients require hospitalization, which will limit the ability of hospitals to perform elective medical procedures and may impact the delivery of life saving services; and
WHEREAS, short-term vacation rentals are being utilized within the City in a manner that provides prolonged close contact between individuals which creates a higher risk of COVID-19 transmission; and
WHEREAS, on July 7, 2020, Miami-Dade County issued Amendment 02 to Emergency Order 26-20, imposing a maximum daytime and overnight occupancy for short-term vacation rentals of up to a maximum of two persons per bedroom plus two additional persons per property not to exceed a maximum of ten persons, and prohibits new rental agreements entered into except on a monthly basis, citing the evidence that County residents and visitors are increasingly using such short term vacation rentals as “party houses” at which many individuals congregate in prolonged close contact; and
WHEREAS, short-term vacation rentals of less than thirty (30) days are of the frequency and nature that they create increased opportunities for disease to spread, especially in multi-family dwellings where there is a high concentration of persons in hallways, elevators, and other communal, shared areas; and
WHEREAS, in order to protect the life, safety, and welfare of the City’s residents and visitors, the City will require that individuals and entities operating short-term vacation rentals within the City shall provide documentation to the City proving compliance with Miami-Dade County Emergency Order 26-20, as amended; and
WHEREAS, in accordance with Section (A)(6) of Amendment 02 to Miami-Dade County Emergency Order 26-20, the City of Sunny Isles Beach can impose more stringent standards within the City than are set forth in the County Emergency Order 26-20, as amended.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
1. Findings.
A. The foregoing recitals are hereby adopted and incorporated herein by reference.
B. The detailed findings of Miami-Dade County Mayor Gimenez as contained in Miami-Dade County Emergency Order 26-20, and all amendments thereto, are incorporated herein by reference.
2. Production of Documentation Required When Operating a Short-Term Vacation Rental.
A. All persons or entities throughout the City of Sunny Isles Beach who operate a Short-Term Vacation Rental, as defined in Chapter 217 of the City’s Code of Ordinances, shall provide the following documentation to the City’s Planning & Zoning Department for each instance that the dwelling is rented:
i. A copy of the lease or rental agreement (in the form of a booking or a reservation generated through advertising platforms such as Airbnb, vrbo, homeaway, etc.) for each rental period reflecting the duration of the rental period for all agreements that are entered into on or after July 9, 2020; and
B. The documentation required under subparagraph (2)(A)(i) shall be submitted to the City no less than forty-eight (48) hours prior to the first day of the given rental period.
i. Documentation must be submitted one of three ways: via email to infopz@sibfl.net, via fax to 305.792.1569 or hand delivered to the Planning and Zoning office on the 3rd floor of the Government Center located at 18070 Collins Avenue, Sunny Isles Beach, FL 33160.
3. Enforcement.
A. Violations of this Order shall be enforced pursuant to Chapter 14 of the City’s Code of Ordinances.
4. Penalties.
A. Failure to comply with the requirements of this Order, or with the provisions of Section (A) (4) of Amendment 02 to Miami-Dade County’s Emergency Order 26-20, which is attached hereto as Exhibit “A” and incorporated herein by reference, will be the following:
i. $1,000 for the first violation;
ii. $2,500 for the second violation;
iii. Suspension of the Short-Term Vacation Rental License upon the third violation for a period of one year as indicated in Section 217-25 of the City’s Code of Ordinances. Any appeals of a suspension shall also be pursuant to Section 217-25 of the City’s Code of Ordinances.
5. This order shall be effective as of 12:01 a.m., July 9, 2020, and shall expire upon the expiration of Amendment 02 to Miami-Dade County’s Emergency Order 26-20, unless terminated earlier by the City Manager.

WHEREAS, on July 9, 2020, the City issued Emergency Order 10, requiring all persons or entities throughout the City who operate a Short-Term Vacation Rental, as defined in Chapter 217 of the City’s Code of Ordinances, shall provide the City with the documentation listed therein, to aid the City in enforcement of the rental duration limitations of Amendment 02 to Miami Dade County’s Emergency Order 26-20; and
Whereas, on August 5, 2020, Miami-Dade County issued Amendment 03 to Emergency Order 26-20, providing that short-term vacation rentals, where otherwise permitted, that are located in any structure operated whole or in part of as a hotel or a condominium, may accept daily rentals, as those short-term vacation rentals are not commonly used for large gatherings and parties; and
WHEREAS, in line with Amendment 03 to Miami-Dade County’s Emergency Order 26-20, which eliminates rental duration limitations on short-term vacation rentals in hotels or condominiums, the City wishes to amend its Emergency Order 10 to clarify that short-term vacation rentals in hotels or condominiums need not comply with the documentation requirements of the City’s Emergency Order 10; and
WHEREAS, in order to protect the life, safety, and welfare of the City’s residents and visitors, the City will continue to require that individuals and entities operating short-term vacation rentals in single-family, townhouse, and duplex dwelling units within the City to provide documentation to the City proving compliance with Miami-Dade County Emergency Order 26-20, as amended; and
WHEREAS, in accordance with Section (A)(7) of Amendment 03 to Miami-Dade County Emergency Order 26-20, the City of Sunny Isles Beach can impose more stringent standards within the City than are set forth in the County Emergency Order 26-20, as amended.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:

All persons or entities throughout the City of Sunny Isles Beach who operate a Short-Term Vacation Rental, as defined in Chapter 217 of the City’s Code of Ordinances, in single-family, townhouse, and duplex dwelling units, shall provide the following documentation to the City’s Planning & Zoning Department via email at infopz@sibfl.net, for each instance that the dwelling is rented:
i. A copy of the lease or rental agreement for each rental period reflecting the duration of the rental period for all agreements that are entered into on or after July 9, 2020; and
B. The documentation required under subparagraph (2)(A)(i) shall be submitted to the City no less than forty-eight (48) hours prior to the first day of the given rental period.
- The balance of Emergency Order 10 remains in full force and effect.
- This order shall be effective as of 12:01 a.m., August 8, 2020, and shall expire upon the expiration of Amendment 03 to Miami-Dade County’s Emergency Order 26-20, unless terminated earlier by the City Manager.
EMERGENCY ORDER 12-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY (CANCELED)

These droplets can land in the mouths or noses of people who are nearby or possibly be inhaled into the lungs; and
WHEREAS, many persons infected by COVID-19 are contagious while they are asymptomatic, and can therefore spread the disease unwittingly; and
WHEREAS, prolonged close contact between people enhances the risk of spreading COVID-19; and
WHEREAS, COVID-19 cases spread rapidly in Miami-Dade County (“County”); and
WHEREAS, the increasing effects of COVID-19 continue to require immediate and extraordinary actions by the City in order to protect the safety, health, and welfare of the public due to the propensity of COVID-19 to spread person to person; and
WHEREAS, COVID-19 poses a health risk to City residents and visitors, particularly those who are elderly, immunosuppressed or otherwise have high-risk medical conditions; and
WHEREAS, the long-term effects of COVID-19 on persons who recover are currently unknown; and
WHEREAS, overtime, positive case rates and hospitalizations due to COVID-19 in the County have stabilized and begun declining, and the County has been allowing for certain activities to resume that pose less of a threat for transmission of the virus; and
WHEREAS, in light of the ever evolving situation related to the spread of COVID-19, the City wishes to terminate select Emergency Orders, and modify others, as detailed more fully below; and
WHEREAS, in accordance with Section (11) of Miami-Dade County Emergency Order 29-20, the City of Sunny Isles Beach can impose more stringent standards within the City than are set forth in the County Emergency Order 29-20, as may be amended.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:

The establishments identified in Section 4 of Miami-Dade County Emergency Order 28-20 shall remain closed.
- City Parks and Recreational Facilities. Use of the City’s parks and recreational facilities will be subject to the following regulations:
A. City Residents Only. With the exception of Samson Oceanfront Park and Pier Park, which will remain open to the general public, all other City parks and recreational facilities shall be limited to City of Sunny Isles Beach residents with proper identification.
B. Park Closures. The below listed parks shall remain closed to the public:
i. Golden Shores Community Park, 201 191 Terrace;
ii. Pelican Community Park, 18115 North Bay Road; and
iii. Bella Vista Bay Park, 500 Sunny Isles Boulevard.
C. Hours of Operation. All City parks not specifically identified in (5)(B) above, will be open subject to the following hours of operations:
i. Pier Park Daily Hours: 7 a.m. – 8 p.m.
ii. Samson Oceanfront Park Daily Hours: 7 a.m. – 8 p.m.
iii. Senator Gwen Margolis Park Daily Hours: 8 a.m. – 8 p.m.
iv. All other City Parks: 8 a.m. – noon Daily (except Tuesdays) and 4 p.m. – 9 p.m. Daily
D. Guidelines:
i. Individuals using the parks are required to adhere to CDC Guidelines concerning facial coverings, with the exception of children under two years old, or persons who have trouble breathing due to a chronic pre-existing condition.
ii. Minors shall always be accompanied by a parent or guardian.
iii. Groups larger than ten (10) people are prohibited from gathering in one place.
iv. Use of parks and recreational facilities shall be for limited passive uses, such as walking, jogging, running, stretching, biking and exercise.
v. Park use is encouraged to be limited to one hour or less.
vi. Directional signage along sidewalks and walkways, established to minimize cross contact, shall be adhered to.
vii. Restrooms at the park will be open for only one (1) person or family at a time.
E. Prohibited Amenities: Use of the following amenities is prohibited: playgrounds; tables; fitness equipment; water fountains; and water features. - Enforcement. Violations of this order may be enforced pursuant to Chapter 14 and Chapter 29 of the City’s Code of Ordinances. Any person or establishment prosecuted under this order and found in violation of the applicable ordinance may be punished by a fine up to $500.00 per day for a first violation and no more than $750.00 per day for a repeat violation. For the purposes of continuing violations, each day that a violation shall continue to exist shall constitute a separate offense.
- Effective Date. This order shall be effective as of 12:01 a.m., September 17, 2020, and shall expire upon the expiration of the City’s Declaration of Local State of Emergency, unless terminated earlier by the City Manager.

WHEREAS, Executive Order Number 20-244 requires local governments to provide an analysis of the economic impact on the restaurant industry and explanation of why limits are necessary for public health if the local government intends to reduce capacity below 100 percent and requiring all other businesses to open as part of Phase 3; and
WHEREAS, as a result of the Governor’s Executive Order Number 20-244, the County issued Emergency Order 30-20 on September 26, 2020, cancelling Emergency Order 28-20 and all amendments thereto, and providing the requisite analysis of the economic impact to the County’s restaurant industry, and setting forth limits on restaurant capacity depending on whether the restaurants can comply with the conditions and requirements set forth in its order; and
WHEREAS, the County’s analysis on the economic impact of its Emergency Order 30-20 on restaurants includes those restaurants located within the City, and the City wishes to adopt the findings set forth in the County’s Emergency Order 30-20, and wishes to enforce all of the limitations and regulations of said order to the restaurants operating within the City’s municipal boundaries.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:

The facial covering exemption for organized sports includes training and practice sessions and matches, but prior to commencing and immediately upon concluding a training or practice session or a match, individuals must wear facial coverings.
ii. Minors shall always be accompanied by a parent or guardian.
iii. Groups larger than ten (10) people are prohibited from gathering in one place.

EMERGENCY ORDER 13-20 AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY – (CANCELED)
[accordion-item title=”Read Emergency Order 13-20″ state=closed]WHEREAS, on March 9, 2020, Florida’s Governor issued Executive Order 20-52 declaring a state of emergency for the entire State of Florida as a result of COVID-19; and
WHEREAS, on March 12, 2020, the City Manager of the City of Sunny Isles Beach (“City”) declared a Local Emergency as a result of COVID-19; and
WHEREAS, the City Manager has extended the declared state of Local Emergency every seven (7) days since that date; and
WHEREAS, since the onset of the COVID-19 public health emergency, both the Florida Governor and the Miami Dade County Mayor have issued orders which have resulted in forced closures of some businesses within the City, and in others, resulted in businesses operating at a reduced capacity; and
WHEREAS, the City’s Code of Ordinances provides for the payment of certain fees related to operating a business within the City, for which, payment is due annually on October 1st; and
WHEREAS, specifically, Section 121-5(A) of the City’s Code of Ordinances provides that the renewal and renewal fee for a Certificate of Use shall be due on October 1st of each year, and that a failure to do so will result in a delinquency penalty of 10% for the month of October, plus an additional 5% penalty for each month of delinquency thereafter until paid, provided, that the total delinquency penalty shall not exceed 25%; and
WHEREAS, Section 197-6(A) of the City’s Code of Ordinances provides that the Business Tax Receipts (“BTR”) issued by the City shall be issued commencing on September 1st of each year, but that the tax shall be due and payable on October 1st, and that a failure to pay by that date shall be considered delinquent and subject to a delinquency penalty of 10% for the month of October, plus an additional five-percent penalty for each month of delinquency thereafter until paid, provided that the total delinquency penalty shall not exceed 25% of the tax due; and
WHEREAS, with respect to the BTRs, Section 197-6(B) of the City’s Code of Ordinances further provides that for those individuals/entities required to obtain a BTR that do not pay the required local business tax within 180 days after the initial notice of tax due (August 1) to obtain the required receipt (February 1) are subject to payment of additional administrative costs of $30 to offset collection efforts and enforcement proceedings which may result in civil actions and penalties, including court costs, reasonable attorneys’ fees; and
WHEREAS, as a result of the COVID-19 public health emergency and the orders related thereto, many businesses in the City have and will continue to experience sudden and unexpected income loss which will significantly impact their ability to pay for the renewal fees for Certificates of Use and BTRs by October 1st, which would result in the application of delinquency penalties as set forth above; and
WHEREAS, as a result of the financial hardships facing businesses in the City, and the need for the City to support its businesses and provide economic relief in these unprecedented times, the City will suspend the imposition of delinquency penalties for renewals of Certificates of Use and BTRs effective October 1st.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:

AND SUPPLEMENT TO DECLARED STATE OF EMERGENCY
WHEREAS, on March 12, 2020, the City Manager of the City of Sunny Isles Beach (“City”) declared a Local Emergency as a result of COVID-19; and
WHEREAS, the City Manager has extended the declared state of Local Emergency every seven (7) days since that date; and
WHEREAS, according to the Centers for Disease Control (“CDC”), COVID-19 spreads mainly from person to person through respiratory droplets produced when an infected person coughs, sneezes, or talks. These droplets can land in the mouths or noses of people who are nearby or possibly be inhaled into the lungs; and
WHEREAS, many persons infected by COVID-19 are contagious while they are asymptomatic, and can therefore spread the disease unwittingly; and
WHEREAS, prolonged close contact between people enhances the risk of spreading COVID-19; and
WHEREAS, COVID-19 cases spread rapidly in Miami-Dade County (“County”); and
WHEREAS, the increasing effects of COVID-19 continue to require immediate and extraordinary actions by the City in order to protect the safety, health, and welfare of the public due to the propensity of COVID-19 to spread person to person; and
WHEREAS, COVID-19 poses a health risk to City residents and visitors, particularly those who are elderly, immunosuppressed or otherwise have high-risk medical conditions; and
WHEREAS, overtime, positive case rates and hospitalizations due to COVID-19 in the County have stabilized and begun declining, and the County has been allowing for certain activities to resume that pose less of a threat for transmission of the virus; and
WHEREAS, in light of the ever-evolving situation related to the spread of COVID-19, the City wishes to reopen select parks, and remove limitations on park opening hours; and
WHEREAS, in accordance with Section (10)(B) of Miami-Dade County Emergency Order 29-20, as amended, the City of Sunny Isles Beach can impose more stringent standards within the City than are set forth in the County Emergency Order 29-20, as may be amended, which governs outdoor activities, including the opening of parks.
NOW, THEREFORE, IT IS HEREBY DECLARED AND ORDERED AS FOLLOWS:
- Emergency Order 12 is hereby amended as follows:
- Findings.
A. The foregoing recitals are hereby adopted and incorporated herein by reference.
B. The detailed findings of Miami-Dade County Mayor Gimenez as contained in Miami-Dade County Emergency Orders 31-20, 30-20 and 29-20, and all amendments thereto, are incorporated herein by reference. - Termination of Emergency Orders. Emergency Orders 01-20, 02-20, 03-20, 05-20, 06-20, 07-20, 08-20, 09-20, 10-20, and 11-20 are hereby terminated.
- Emergency Order 04-20. Emergency Order 04-20 shall remain in full force and effect, and the requirements contained therein are not modified by this Order.
- Retail and Commercial Establishments. All retail and commercial establishments (collectively “establishments”), as identified in Miami-Dade County Emergency Order 30-20, located within the jurisdiction of the City of Sunny Isles Beach, are permitted to open, and remain open, provided that each such establishment complies with the requirements set forth in Miami-Dade County Emergency Order 30-20 and 31-20, as may be amended.
- City Parks and Recreational Facilities. Use of the City’s parks and recreational facilities will be subject to the following regulations:
A. City Residents Only. With the exception of Samson Oceanfront Park and Pier Park, which will remain open to the general public, all other City parks and recreational facilities shall be limited to City of Sunny Isles Beach residents with proper identification.
¨B. Park Closures. The below listed parks shall remain closed to the public:
i. Golden Shores Community Park, 201 191 Terrace.
ii. Pelican Community Park, 18115 North Bay Road; and
iii. Bella Vista Bay Park, 500 Sunny Isles Boulevard.
B.C.Hours of Operation. All City parks are open for normal hours of operation except for the following: not specifically identified in (5)(B) above, will be open subject to the following hours of operations:
i. Pier Park Daily Hours: 7 a.m. – 8 p.m.
ii. Samson Oceanfront Park Daily Hours: 7 a.m. – 8 p.m.
iii. Senator Gwen Margolis Park Daily Hours: 8 a.m. – 8 p.m.
iv. All other City Parks
a. Mornings (daily except Tuesdays): 8 a.m. – noon
Pelican Community Park, 18115 North Bay Road (Exterior Amenities Only)
Monday thru Friday, 4:00 p.m. – 9:00 p.m.
Saturday and Sunday, 8:30 a.m. – 9:00 p.m.
C. D. Guidelines:
i. Individuals using the parks are required to adhere to CDC Guidelines concerning facial coverings, with the exception of children under two years old, or persons who have trouble breathing due to a chronic pre-existing condition. Notwithstanding anything else herein to the contrary, facial coverings shall not be required while actively engaging in an organized sport. For purposes of this exemption, organized sport means a sport such as soccer, baseball, basketball, softball, boxing, and other recognized sport that is part of an established athletic league or part of an organized program. The facial covering exemption for organized sports includes training and practice sessions and matches, but prior to commencing and immediately upon concluding a training or practice session or a match, individuals must wear facial coverings.
ii. Minors shall always be accompanied by a parent or guardian.
iii. Groups larger than ten (10) people are prohibited from gathering in one place.
iv. Directional signage where present along sidewalks and walkways, established to minimize cross contact, shall be adhered to.
v. Restrooms at the park will be open for only one (1) person or family at a time.
- Enforcement. Violations of this order may be enforced pursuant to Chapter 14 and Chapter 29 of the City’s Code of Ordinances. Any person or establishment prosecuted under this order and found in violation of the applicable ordinance may be punished by a fine up to $500.00 per day for a first violation and no more than $750.00 per day for a repeat violation. For the purposes of continuing violations, each day that a violation shall continue to exist shall constitute a separate offense. The monetary penalties described herein shall not apply to violations of Section 6(DC)(i) of this order; nevertheless, a violation of that subsection may result in the violator being removed from the City’s park or recreational facility.
- Effective Date. This order shall be effective as of 12:01 a.m., March 15, 2021, and shall expire upon the expiration of the City’s Declaration of Local State of Emergency, unless terminated earlier by the City Manager.
