It is important to know if the contractor has a valid License/Certificate of Competency, if he/she can provide recent references, and if the contractor has expired permits. Other important information you should know:

  • Check with the City of Sunny Isles Beach, Building Department for up-to-date contractor registration.
  • Check with the Florida Department of Business and Professional Regulation for complaints against a contractor’s license.
  • Use a contractor that will fulfill their contract and return after completion of the job for warranty issues.

Remember that compliance with the Code is ultimately the responsibility of the property owner. Therefore, be sure that all inspections have been approved, that a Certificate of Completion (if applicable) has been obtained and, before making a final payment to a contractor, that you are satisfied with the work. Make sure that an agreement between you and a contractor includes all these provisions. Also check the Better Business Bureau to see if any complaints have been filed.

It is the law to obtain a building permit prior to commencing work. When a permit is submitted to the Building Department, it is reviewed to see that it meets established minimum criteria. The review and approval process allows problems to be identified and corrected before any non-complying work occurs.

  • During the process of submitting a permit, a contractor’s licensing and insurance are verified.
  • Having a permit allows a person knowledgeable in construction the opportunity to inspect and confirm that minimum code prescribed construction requirements are met.
  • The transfer of property could be delayed when non-permitted work is discovered. Work completed without permits and/or inspections is deemed to be unsafe.
  • Work that is done without a permit is subject to double permit fees and may have to be partially or completely demolished.

If the tile is outside or exposed to wind loads, a permit and inspection is required. In a multiple-floor, multiple-living facility, tile requires soundproofing between floors and must be permitted and inspected. In a single-family home all interior tile can be installed without permits, but any exterior installation requires a permit.

A Certificate of Use is a document issued by the Code Compliance Department after verifying compliance with all City codes. According to City Code, Chapter 121: Certificates of Use, a Certificate of Use is, “A document issued by the Director of the Code Compliance and Licensing Department after verifying with the City Manager and his/her designee, as appropriate, that the zoning use classification of any business, within any approved structure or building or unit therein, is allowed, prior to its occupancy and after inspection of the premises and proof of compliance with all the requirements of the City Code of Ordinances and all other applicable laws and regulations; provided, however, that no certificate of use shall be issued until it has been reviewed and approved by both the City Manager and his/her designee, as appropriate, and the Director of Code Compliance and Licensing.”

Home-based businesses are very strict. Section 265-44(H)(i) of the City’s Code of Ordinance does not allow for any customers or clients on site. This type of business will not be allowed in a home residence. For this business to be allowed it will require a variance of the code, and this variance is obtained by processing and acquiring a City Commission approval through a Public Hearing. The Public Hearing cost is in the range of $10,000 and approval is not guaranteed.

A home-based business is a business that is conducted at a residential unit. A permit is required for a home-based business. According to City Code, Chapter 265: Zoning, Section 265-44, “Specific Use Regulations,” home occupation is the accessory use of a portion of a dwelling unit as a personal office or business, by a resident of the dwelling only. Home occupations are permitted in any dwelling unit subject to the approval by the Zoning Division of the Code Compliance Department. A home occupation must be conducted by the permit applicant living within the dwelling which is his or her primary residence, or in an accessory building which is normally associated with residential use and shall not exceed 25% of the floor area of the residence. A permit for a home-based business is valid only for the original applicant and is not transferable to any resident, address or any other occupation. Upon termination of the applicant’s residency, the home occupation permit shall become null and void. There are many other limitations to home occupations that need to be followed in order to avoid code violations.

The Local Business Tax Receipt is a privilege tax imposed by City Ordinance on every person, firm, partnership, or corporation engaged in business within the city. Fishing

The historic Newport Fishing Pier, located at 16501 Collins Avenue is a favorite fishing spot among locals and visitors. Bring your own bait and fishing poles.

Limited metered parking is available in the Pier Park parking lot and additional metered parking is available at Gateway Park garage, 151 Sunny Isles Blvd.

Due to the possibility of hooks, lines and other fishing equipment injuring swimmers or sea birds, fishing is not allowed in the Atlantic Ocean from the beach. The other reason is that bait and shiny fishing equipment could attract larger sea species closer to shore posing a danger to anyone swimming in the area.

The Code Compliance Department enforces Section 108-4 of the City’s Code of Ordinances that indicates the following:

Except in designated areas, no person shall fish in the Atlantic Ocean by use of hook and line, seine, trap, spear gig or other device.

The City provides special beach wheelchairs and walkers through the Ocean Rescue Service, 7 days per week. To use one of our beach wheelchairs or walkers, call the Cultural and Community Services Department at 305.792.1706 or speak to a lifeguard at any of the five Lifeguard Towers. The wheelchairs are very stable and very easy to roll and maneuver in the softest sand, and even on the water’s edge. All you need is a license or form of identification and Ocean Rescue will accommodate your needs.

For residents of Sunny Isles Beach, Miami-Dade County is providing bus service at pre-set locations. Florida Statutes and Rules of the Florida State Board of Education establish when students are eligible for transportation on public school buses.

  • Students who are attending their designated home/residence school and who live more than two (2) miles from the school will generally be eligible for transportation.  However, this rule does not apply to students in magnet/school choice programs nor to most other students who are attending a school other than their designated home/residence school.
  • Special needs students shall receive transportation in accordance with the provisions of the student’s Individual Education Plan (IEP) or “504” Plan.  However, this does not apply to students who have been enrolled in magnet/school choice programs.  All such students will receive transportation on the same basis as regular education students, regardless of what may be included in an Individual Education Plan (IEP) or “504” Plan.
